A court has ordered the immediate discharge of Kilmar Abrego Garcia from detention by ICE, concluding his ongoing confinement lacks lawful basis.

"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been taken back into custody, again without legal justification," the judge wrote in her ruling.

The situation stems from a mistaken removal to El Salvador in March, which US authorities later acknowledged was an error. After his repatriation to the United States to answer human smuggling allegations, he was held in federal detention.

In her decision, the court noted that the government does not have a current deportation order, which prevents them from deporting Mr. Abrego Garcia "at this juncture."
